§72.051

Texas Civil Practice and Remedies Code § 72.051 — the Texas Trucking Liability Act, enacted by House Bill 19 and effective September 1, 2021. The Act restructures truck accident litigation in Texas, most notably through § 72.052's bifurcated trial procedure, which separates the question of driver/carrier fault (Phase 1) from the question of the carrier's direct negligence in hiring, supervision, or retention (Phase 2). The Act was controversial and was backed by the Texas Trucking Association.
